Returning to County Service in the Future:  Reemployment

While Sacramento County remains in a staff reduction mode right now, as the economy stabilizes, and employees retire or take other jobs, openings will occur in our workforce. For employees who have been laid off, there are certain rights afforded to you to ensure that you have an opportunity to resume your county service. The following information outlines the reemployment process; if you have additional questions, please contact the Personnel Services Department.

Keep in mind that provisions of certain labor agreements or MOU’s may vary the implementation of these guidelines. The county’s current negotiated agreements can be found on the Personnel Services website.

Reemployment rights

Persons who are laid off shall have the following entitlements relating to reemployment:

  • A person who held permanent status in the class from which the person was laid off, shall during the two-year period following the effective date of layoff be entitled to be appointed from a departmental reemployment list to a vacancy authorized to be filled in that class within the department from which the person was laid off. 

  • A person who held permanent status in the class from which he or she was laid off, shall also, during the two-year period following the effective date of layoff, be entitled to certification from a Countywide reemployment list for a vacancy in the class from which the person was laid off, which is authorized to be filled.

Departmental Reemployment Lists

The County shall prepare a departmental reemployment list for each class in each department in which an employee with permanent status in that class is laid off. As personnel are separated from a class in which they held permanent status their names shall be added to the list for the class and department in which the layoff occurs. The order of personnel on each departmental reemployment list shall be based upon seniority according to the original date of appointment to the class to which the list refers.

Countywide Reemployment Lists

The County shall prepare countywide reemployment lists for each class from which personnel with permanent status in the class are laid off. Each list shall constitute a merger from departmental reemployment lists of persons who are laid off from the class and who hold permanent status. The order of personnel on each countywide reemployment list shall be based upon seniority according to the original date of appointment to the class to which the list refers.

Reemployment List Priorities

  • Vacancy is filled from department reemployment list. 
  • Most senior person is offered an appointment. If person declines the appointment, next senior person is offered the appointment. 
  • Countywide reemployment list will not be used until there are no more names on department re-employment list in that class, or unless all persons on department reemployment list declined the appointment. 
  • If Countywide reemployment list is used, 3 persons are certified. One additional name will be certified for each additional vacancy in excess of one. If there are less than 3 names on the list, additional names will come from the regular eligible list to make up 3 persons.

Effect of Reemployment

  • When a person is reemployed from either a departmental reemployment list or a County-wide reemployment list, the period of unemployment following the layoff shall not be treated as an interruption of service for purposes of reestablishing salary, benefits or seniority. The period of such unemployment shall be treated as County service for seniority purposes. However, with the exception of seniority, the period of unemployment shall not be treated as County service for any other purposes. 

  • Effective July 1, 2009, any person who is reemployed from either a departmental reemployment list or a countywide reemployment list into a permanent position in County service shall be entitled to reinstatement of any sick leave balances that had previously accrued to that employee as of the effective date of lay-off.

Removal from Department Reemployment List

  • Expiration of 2 years following layoff 
  • Appointment to regular position within County service 
  • Declined appointment 
  • Person does not want to be appointed from list and states it in writing

Removal from Countywide Reemployment List

  • Expiration of 2 years following layoff
  • Appointment to regular position within County service
  • Declined appointment unless it is on the basis of the identity of the department, geographical location of the job, or shift schedule of the job
  • Person does not want to be appointed from list and states it in writing
  • Removal from department reemployment list
